What happened
FMCSA’s enhanced State review requirements took effect on Sept. 18, 2026. They apply only to new Requests for Data Review submitted on or after that date, so the process is not retroactive. DataQs lets drivers, motor carriers and their representatives request review of federal or State crash, inspection and violation data they believe is incomplete or incorrect. States receiving Motor Carrier Safety Assistance Program funding must review eligible inspection requests submitted within three years of the inspection and crash requests submitted within five years of the crash.
What drivers should do
The revised process has three levels. An initial denial cannot be decided solely by the officer who issued the inspection; reconsideration must involve independent subject-matter experts who were not part of the initial decision; and final review goes to a senior decision-maker or independent panel. FMCSA’s published standards set 21 days for the initial review, 21 days for reconsideration and 45 days for final review. When no correction is made, the decision must identify the evidence reviewed, explain the result and state the next review step. These protections do not automatically remove a violation or guarantee that an unsupported request will succeed.
Why this matters to our community
Before filing, compare the official record with the inspection report or crash documents and identify the exact field, violation code or attribution you believe is wrong. Upload focused evidence such as the inspection report, citation and court disposition, repair record, photographs, dashcam file, ELD extract or other dated document that directly supports the request. Keep copies and the RDR number, monitor Response History, answer requests for more information promptly and use the stated reconsideration or final-review step if needed. Motor carriers access DataQs through the FMCSA Portal; drivers using Login.gov should use the same email as their DataQs account. Useful English terms include Request for Data Review, supporting evidence, initial review, reconsideration, final review, response history and no data correction.
